Presidential Threshold dalam Sistem Presidensial di Indonesia: Perspektif Konstitusi

Konstitusi merupakan hukum dasar yang menjadi landasan penyelenggaraan pemilihan umum, termasuk pelaksanaan pemilihan umum presiden dan wakil presiden. Ambang batas pencalonan presiden dan wakil presiden (presidential threshold) tidak sejalan dengan amanah konstitusi. Penelitian ini bertujuan untuk menganalisis norma presidential threshold dan sistem presidensial di Indonesia. Metode penulisan menggunakan metode normatif, dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukkan bahwa ketentuan presidential threshold bertentangan dengan ketentuan UUD NRI 1945 dan menderogasi hak konstitusional partai polittik untuk mencalonkan presiden dan wakil presiden. Ketentuan presidential threshold juga bertentangan dengan semangat penguatan sistem presidensial dan cenderung quasi parlementer.
